Dividing car insurance important in divorce cases

We All Need A Champion

Michigan couples who are ending their marriages must work to disentangle their finances from each other in the property division stage of their divorces. One thing that they should not overlook is separating themselves from their car insurance policies. There are several rules regarding this about which divorcing spouses should be aware.

People are not allowed to simply remove the name of their spouse from an insurance policy. Instead, they must obtain the consent of the other party. The spouses must also have separate residences so that they no longer share potential liability.

Most insurance companies want the owners of a vehicle to be listed on the insurance policies. This means that the couples will need to remove one spouse's name from any jointly owned vehicle, which may require one person to refinance the vehicle in his or her own name. Both parties should get cars in their own names separately, and one will need to find a new car insurance policy. That person should not agree to remove his or her name from the original insurance policy until a new policy is in place so that there are no insurance coverage gaps.
