Significant and Surprising Financial Issues in Divorce when the wife makes more in income than the husband

In our culture, for many reasons, it has been typical that the wife in a marriage brings in to the marital estate less money than does the husband.  In the event the wife is a "homemaker," it certainly is recognized that she brings financial value to the marriage, in calculating a division of property in a divorce property settlement.  And that fact pattern also often justifies (in Michigan using something called MarginSoft software) a calculation that takes into account the duration of the marriage and the relative educational and ability, so-called, to earn.  These calculations lead to payments by the husband to the wife, after the divorce, of spousal support, also known in the past as alimony.

Important IRS Guidelines on Alimony

This blog is less philosophical regarding divorce --but provides IRS Guidelines on whether a person may deduct spousal support/alimony payments made or, unfortunately, whether taxes are due on "income" received because such payments were received.  We are pleased to assist in interpreting these guidelines in your case, if that would be helpful to you.

Valuable Things to Know about Divorce and the Human Emotion Cycle

It is almost like reading a book, to help persons as a divorce lawyer.  There are almost chapters that open up fairly predictably, if you watch closely and care. It is a human cycle of strong emotions that flow out and all over: betrayal, anger, grief, upset, serious fear of money issues, WHAT will the future be like; can I manage?  Add children to this mix and oh, boy!  And as a divorce lawyer, I can tell you it is really important to have a knowledgeable friend.  You have to talk through this experience.  And I tell people, please don't do this divorce yourself or be forced to make agreements in the living room.  There are laws that protect both husband and wife.  That's my job.  The lawyer needs to listen and learn and help and listen some more.  And, most of all, provide the comfort that there are laws.  There are fair and equitable standards.  You have more than just a knowledgeable friend, you have an ADVOCATE!!  The cavalry is on the way to your side.
